1. Operator and acceptance
FileUpGo Data Recovery is developed and operated by Fileupgo team, an independent software developer based in Hong Kong. References to “Fileupgo team,” “FileUpGo Data Recovery,” “we,” or “us” mean that operator. By accessing the website, purchasing a license, installing, or using FileUpGo Data Recovery, you agree to these Terms and the installer End User License Agreement. If you do not agree, do not use the software or services.
2. Eligibility, authority, and license
You must be legally capable of entering into this agreement. You may use FileUpGo Data Recovery only on devices, storage media, accounts, and data that you own or are expressly authorized to inspect or recover. Subject to these Terms, Fileupgo team grants you a limited, non-exclusive, non-transferable, revocable license for lawful personal or internal business use. The software is licensed, not sold.
3. Plans, activation, and payments
Scanning and browsing results are free. File recovery may require an active license under the current service policy. One-month and one-year licenses expire at the stated time. A lifetime license has no fixed expiry after valid activation, but does not guarantee compatibility with future hardware or operating systems, access to future software versions, or permanent availability of online services. License status may be verified and a license may be suspended or revoked for a refund, chargeback, fraud, abuse, unauthorized distribution, or material breach of these Terms.
Purchases may be processed by an authorized third-party payment provider, acquiring institution, or merchant of record. The provider shown at checkout may apply its own buyer, billing, tax, refund, and privacy terms. Prices, taxes, license duration, device limits, and any refund terms shown at checkout form part of the purchase terms. Fileupgo team does not collect or store full payment-card details.
4. Prohibited use
You must not use FileUpGo Data Recovery unlawfully; access another person’s device or data without authorization; violate privacy, data-protection, cybersecurity, export-control, evidence, or intellectual-property laws; bypass licensing or security controls; distribute license keys; introduce malicious code; disrupt the services; or reverse engineer, decompile, disassemble, modify, sublicense, rent, resell, or redistribute the software except where applicable law expressly permits it.
5. Data-recovery risk and your responsibility
FileUpGo Data Recovery provides technical functionality only. It is not a backup, data-custody, data-security, forensic-certification, legal, or professional-advice service. Data recovery is inherently uncertain. Deleted or damaged data may be incomplete, corrupted, incorrectly identified, overwritten, unrecoverable, or unsuitable for your intended purpose. Continued use of an affected device, installing software, and saving output to the source drive can overwrite recoverable data.
You are solely responsible for deciding whether and how to use the software, protecting your devices and data, making backups where reasonably possible, stopping unnecessary writes to the affected medium, selecting a different physical drive as the recovery destination, ensuring sufficient capacity and permissions, and validating recovered files before relying on them. Fileupgo team does not take custody of your scanned or recovered files and does not guarantee their safety, integrity, confidentiality, availability, evidentiary value, or successful recovery.
6. Privacy and network features
Scanning and recovery are performed locally, and FileUpGo Data Recovery does not upload scanned file contents in ordinary operation. The software may connect to Fileupgo team services for licensing, policy checks, security, and support. The Privacy Policy explains what information is processed and how it is used.
7. Third-party components and services
FileUpGo Data Recovery may include or interoperate with third-party libraries, runtimes, drivers, open-source components, hosting services, payment services, and email services. Their separate licenses and terms may apply. Fileupgo team is not responsible for a third party’s independent service, availability, acts, or omissions, except to the extent responsibility cannot lawfully be excluded.
8. No warranty
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FILEUPGO DATA RECOVERY AND THE RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT EXPRESS, IMPLIED, OR STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RECOVERY SUCCESS, DATA INTEGRITY, SECURITY, AVAILABILITY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. NO DESCRIPTION, PREVIEW, SCAN RESULT, ESTIMATE, OR SUPPORT RESPONSE GUARANTEES THAT A FILE CAN BE RECOVERED OR USED.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FILEUPGO TEAM WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE LOSS, OR FOR LOSS, CORRUPTION, DISCLOSURE, OR UNAVAILABILITY OF DATA; LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, OR GOODWILL; BUSINESS INTERRUPTION; DAMAGE TO A DEVICE OR STORAGE MEDIUM; FORENSIC OR EVIDENTIARY LOSS; OR THE COST OF SUBSTITUTE SERVICES, ARISING FROM OR RELATING TO FILEUPGO DATA RECOVERY, EVEN IF THE POSSIBILITY WAS KNOWN. FILEUPGO TEAM’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO AN AFFECTED LICENSE OR TRANSACTION WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT LICENSE OR TRANSACTION.
Nothing in these Terms excludes or limits liability for fraud or wilful misconduct, death or personal injury caused by negligence, or any warranty, consumer right, privacy obligation, or other liability that cannot legally be excluded or limited. Mandatory rights available in your place of residence continue to apply.
10. Product changes, availability, and termination
Fileupgo team may maintain, secure, modify, suspend, or discontinue software features or online services and may separately release future software versions. A lifetime license does not include a promise of access to future versions. These Terms end automatically if you materially breach them, without limiting rights that have already accrued. Provisions that by their nature should survive—including ownership, disclaimers, liability limits, and dispute terms—remain effective.
11. Intellectual property
Fileupgo team and its licensors retain all rights, title, and interest in FileUpGo Data Recovery, its software, website, branding, documentation, and related intellectual property. No right is granted except the limited right to use FileUpGo Data Recovery under these Terms and applicable third-party licenses.
12. Governing law and disputes
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles. The courts of Hong Kong have jurisdiction over disputes, but this does not deprive a consumer of any mandatory protection or right to bring a claim in another forum that applicable law does not permit the consumer to waive.
13. Changes and contact
Fileupgo team may update these Terms to reflect changes in the software, services, law, or business practices. The revised version will show a new effective date and will apply prospectively unless law requires otherwise. Material changes will be communicated where reasonably appropriate.
